NOTICE OF INFORMATION PRACTICES & PRIVACY POLICY

  1. Virginia, California, Connecticut, Illinois, Minnesota, New Jersey, Colorado, Georgia, Kansas, Nevada, Oregon, Washington - A credit report or other investigative report such as MVR, underwriting reports, etc about you, policy holder, drivers, employees may be requested in connection with this application for insurance. Any information which we have or may obtain about you or other individuals listed as policyholders on your policy will be treated confidentially. However, this information, as well as other personal or privileged information subsequently collected, may, under certain circumstances, be disclosed without prior authorization to third parties such as to our affiliated companies for claims handling, servicing, underwriting and insurance marketing. Personal information also may be disclosed to affiliated and non-affiliated companies for non-insurance marketing purposes, unless you write to us at the address provided with your policy and direct us not to make such disclosure. You have the right to see personal information collected about you, and you have the right to correct any information which may be wrong. If you are interested in obtaining a description of our information practices, and your rights regarding information we collect, ask your agent, or, ir you have been issued a policy, please write us at the address provided with your policy.

  2. Arizona - As described in ARIZONA revised statute 20-2104(c), a credit report or other investigative report about you may be requested in connection with this application for insurance.  Any information which we have or may obtain about you or other individuals listed as policyholders on our policy will be treated confidentially.  However, this information, as well as other personal or privileged information subsequently collected, may under certain circumstances, be disclosed without prior authorization to third parties such as to our affiliated companies for claims handling, servicing, underwriting and insurance marketing.  Personal information also may be disclosed to affiliated and non-affiliated companies for non-insurance marketing purposes, unless you write to us at the address provided with your policy and direct us not to make such disclosure.   3. Protecting Customer Information

    1. Diesel makes it a priority to protect your personal and privileged information. We do not sell your information. We limit access to your personal and privileged information to those persons who need to know it to perform their jobs and to provide service to you. We maintain physical and electronic safeguards to protect such information from unauthorized use or disclosure.

    2. You may have additional concerns about the privacy and security of information collected through our web site. We are committed to protecting the online privacy of visitors to our web site. We maintain physical, electronic, and procedural safeguards to secure your personal information, “perfect security” does not exist on the internet, and there is always some risk in transmitting information electronically. We use security measures consistent with industry standards, such as firewalls and encryption technology, to protect your information.

Information We Collect - We collect and use information that we believe is necessary to serve you effectively, such as information we receive from your insurance application and communications from you; information about your transactions with us; information that you provide to us on our web site; information from your insurance agent or broker; information that we receive from consumer reporting agencies, DOT, DMV; information from website usage (or traffic); information from customer lists provided by other organizations and marketing data providers; information from governmental agencies and insurance-support organizations; and information relating to insurance claims, which may include medical information. This information enables us to underwrite policies, process claims, ensure proper billing, and service accounts. We also may collect customer information from insurance agents who may use our Internet based portal to submit, apply, endorse, update, make payments, and inquire about the status of customer accounts.

We share information that we collect only as required or permitted by law to industry regulators, law enforcement agencies or other governmental authorities, anti-fraud organizations, third parties who assist us in processing the transactions authorized by you and in providing services to us and to you; companies within our group; your insurance agent or broker; third parties with whom we have joint marketing agreements in order to market our products; conduct research and analyze data to improve our products and services; attorneys or other authorized persons in connection with matters in litigation, as required by subpoenas and court rules and orders; our attorneys, accountants, and auditors; and such other parties as are specifically permitted or required by law.

CALIFORNIA PRIVACY NOTICE - For California Residents or Insureds

  1. Under the California Consumer Privacy Act, as amended from time to time, and the applicable regulations (the “CCPA”), Diesel is required to notify California customers about collection, use, disclosure, and retention of their personal information. This section applies to processing of personal information of California residents to the extent the information is subject to the CCPA. There are several exemptions from the CCPA, and in accordance with the CCPA this section does not apply to personal information collected pursuant to: (i) the Gramm-Leach-Bliley Act and its implementing regulations (such as information collected in connection with the sale, issuance and maintenance of an insurance policy or claim); (ii) the California Financial Information Privacy Act; or (iii) the Health Insurance Portability and Accountability Act (“HIPAA”).

  2. How We Collect And Use Personal Information - As stated in the section on Our Commitment To Privacy, we collects personal information. We collected customers’ personal information so we can provide products and services and satisfy our legal obligations. Further, we may disclose customers’ personal information to others who provide services to us, and to government agencies and regulators so that we can provide our products and services to customers. We may also disclose a consumer’s personal information to our affiliates or in the event of a business transfer. Additional detail is set forth below.

  4. Cookies and Website data - Our website may provide links to content or services controlled or owned by other parties. When website visitors interact with such other party content or services, they may be disclosing their personal information to such parties. We do not sell/share for money any personal information about our customers with unaffiliated entities. Under the CCPA, the manner in which we may use cookies or other tracking technologies may constitute a “sale” or a “share.” You have the right to opt-out of sale or share personal information.

  5. How Long We Retain Personal Information - Generally, we keep your personal information for as long as is reasonably required for the purposes described in this Privacy Notice. We may retain your personal information if necessary to meet legal, regulatory, tax, or accounting needs.

  6. Your Privacy Rights As A California Resident - Right To Know - You have the right to request that we disclose to you the personal information we collect, use, disclose, sell, or share about you. We will also confirm receipt of your request within 10 business days of receipt:

    2. The categories of sources from which the personal information was collected

    3. Our business or commercial purposes for collecting, selling, or sharing personal information

    4. The categories of third parties (recipients) to which we disclose personal information

    5. The specific pieces of personal information we have collected about you

    6. A list of all third parties to which we have disclosed personal information, as defined under California Civil Code Section 1798.83(e) (a/k/a the “Shine the Light Law”), during the preceding year for third-party direct marketing purposes, if applicable

  7. Right to Request Deletion - You have the right to request that we delete your personal information. You may make such a request by sending the by sending email to Hello@Dieselinsure.com and providing a written request. We will respond to your request as soon as we can, and no later than legally required. We will also confirm receipt of your request within 10 business days of receipt. You should be aware, however, that California law, Dept of Insurance and other legal or regulatory constraints may apply, allowing us to retain your information under, such as when retaining your personal information is necessary for us to complete a transaction with you or provide you with a service you have requested. In such circumstances, we will notify you of any denial of your deletion request.

  8. Right To Correct Inaccurate Information - If you believe that any of the personal information we maintain about you is inaccurate, You may make such a request by sending an email to Hello@dieselinsure.com with a request. pon receipt of a verifiable request to correct inaccurate personal information, we will use commercially reasonable efforts to correct the information as you direct. We will respond to your request as soon as we can, and no later than legally required. We will also confirm receipt of your request within 10 business days of receipt.

Verification And Using An Authorized Agent - Only you, or someone legally authorized to act on your behalf, may make a verifiable request to know, delete, or correct as it relates to your personal information. To verify the identity of the requestor and authority to make the request, you will be required to provide your name, email address, and other unique information that we may determine is required in order to connect you to the information that we retain. In accordance with the CCPA and in order to safeguard personal information, we cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. You may use an authorized agent to submit a request. To use an authorized agent, you will need to (i) provide written instruction to your agent and verify your identity to us; or (ii) provide a power of attorney pursuant to California Probate Code Sections 4000 to 4465.

  11. California’s “Shine the Light” Law - If you are a California resident, you are entitled, once a year, free of charge, to request information regarding our disclosure, if any, of certain categories of personal information to third parties for their direct marketing purposes in the preceding calendar year.
