QUOTE TERMS
Updates. It is the duty of insured to notify us when other coverages are needed or any change to operations, exposure, vehicles, trailer, drivers, routes or any other information requested.
Exclusions. Quote terms subject to compliance with Program Eligibility and Exclusion List. Please review to verify compliance.
Policy Type. This policy only covers scheduled vehicles, trailers, and drivers. Any changes must be approved in advance for coverage to apply. We do not cover unscheduled vehicles, trailers or drivers
Changes. Premiums quoted are based on the preliminary information provided by you, and are subject to change pending underwriting review. Should any changes or corrections need to be made please notify us immediately. Additional underwriting may be conducted, which could affect policy terms, eligibility, or rates.
Quote Proposal. The quote may differ from your request. Please review the terms carefully to ensure they align with insurance requirements. Additional underwriting must be performed, and this isn't a guarantee of terms or eligibility.
Quote is a Summary. The quote proposal is issued for informational purposes only. The quote does not alter, amend, or extend coverage. Only the issued insurance policy can afford coverage. Please review the proposal carefully as the terms and conditions of coverage may differ from those requested on application. This is an indication and may be withdrawn prior to binding or due to updated information.
Compliance with Regulations. Forms, taxes, coverage, or fees subject to change to comply with state law.
Form Review. Template coverage forms and form list are available upon request.
Review Terms. The coverage, limits, terms and conditions may vary from what was requested. Please review acceptability.
Surplus Lines Notice. Please review applicable State Notice regarding Surplus Lines carrier. Policies maybe written with a non-admitted surplus lines insurer and subject to surplus lines disclosure, tax and fees.
Agent Warranty. The Agent warrants that they hold valid insurance licenses within the insured's state and that all submitted information is accurate and has been verified with the Insured. Prior to placement with a surplus lines insurer, the Agent diligently sought coverage in the admitted market and will provide required diligent search affidavits.
Non Refundable. Policy Fees and the Minimum Earned Premium of 25% are non refundable after binding.
Quote is valid for 30 days from quote date.
APPLICANT REPRESENTS
If you bind coverage. The insured warranties they have reviewed the quote proposal and request that the insurance company or MGA bind coverage, subject to the premiums and terms outlined in this proposal and governed by the policy terms and conditions in current use by the insurance company.
Information submitted herein becomes a part of my Application, and in the event that coverage is bound, is subject to the same representations and conditions.
To the best of their knowledge the statements set forth herein are true and complete. This quote and policy are based on information provided by you. This information is material to underwriting eligibility.
If the information provided changes at any time, the Applicant will immediately notify the agent and MGA of such change, and MGA may modify or withdraw any quote.
Signing of this Application does not bind the Insurer to offer nor the Applicant to accept insurance, but it is agreed that this Applicant shall be basis of insurance and will be attached to and made part of the policy should a policy be issued.
Updates. It is the duty of the insured to notify us immediately when other coverages are needed or any change to operation, exposure, vehicle, trailer, drivers, route, or other information requested in the application. This information is material to underwriting and could effect eligibility.
Exclusion List. Insured certify they have reviewed the Exclusion List and confirmed the insured does not perform, conduct, operate or have any exposure to any of the items listed. If this statement is Not accurate please inform your agent and Diesel asap.
Insured Affidavit of Accurate Information. Insured and Agent certify that the information stated herein is accurate as of the date signed. Insured will inform agent if any of the information is not accurate or incomplete. The insurance application information is material and could affect program eligibility and insurability.
Insured Affidavit of Scheduled Policy. Insured and agent acknowledge this is a scheduled vehicle, trailer and driver policy. Only those vehicles and drivers that are approved and scheduled on the policy are covered. Advanced notice of changes is required for underwriting approval.
Exclusions. Insured complies with criteria outlined in quote proposal and noncompliance could result in cancellation or claim denial. Any Exposure to Exclusion List will result cancellation and claim denial.
BILLING & INVOICE TERMS
Deposit Terms: Deposit must be collected by broker upon binding. We require confirmation of deposit collection by broker to issue DOT or State Filings.
Payment Due: Full Payment of invoice is due before 10 days from Effective date
Late Payments: Failure to pay full invoice amount will result in cancellation and we may not reinstate.
Premium Finance: We accept Premium finance and negotiated terms www.PavoInsure.com to sign up.
PROGRAM TERMS AND CONDITIONS
Important Information. Please review Terms & Conditions below as they can alter coverage which are essential to the placement of insurance. Notify us if you have any questions. The agent and Insured certify that they have reviewed the document prior to binding or purchasing insurance.
Broker Self Service: Broker can self service updating quotes, application, bind request, and endorsements on the Diesel online portal. Log in and search by Insured or Quote ID and follow instructions. If you need assistance please email Hello@Dieselinsure.com
Filing request: Upon binding we will issue the filing after confirmation the premium deposit has been collected.
Invoice & Payment terms. In the event the finance company issues a cancellation, the insurance company and broker have the right to honor the finance company’s cancellation date without further notice. We reserve the right request or void reinstatement on accounts that have been cancelled more than once for non-payment of premium, returned checks, NSF, or failure to pay. Premium financing requires Down payments and policy fee due prior to binding any coverage. Acceptance of this proposal also authorizes us to act as our exclusive representative as regards to receiving premium. Any cancellation after the acceptance of this proposal is subject to the Policy Cancellation Clause. Applicable fee(s) are earned in full and non-refundable.
Policy Terms define coverage. Any marketing document, advertisement, quote proposal, insurance offer, binder or document produced by Diesel Insurance does not amend or affect coverages, terms or conditions of any insurance policy. Diesel does not represent that coverage does or does not exist for any claim, loss or scenario. Coverage depends strictly on the facts and circumstances involved in the claim, applicable policy provisions, and laws. The availability of coverage referenced in any document can depend on underwriting qualifications and subject to change. Nothing on the Diesel website or document produced by Diesel constitutes an offer, inducement, or contract of insurance. The financial strength and size ratings can change and should be reevaluated before coverage is purchased. This document is intended for licensed insurance agency only. Coverage is subject to applicable policy terms, conditions, limits, and exclusions. Surplus lines insurance is only sold through licensed surplus lines producers and surplus lines insurers do not participate in state guaranty funds.
Wrong receipt. This message is intended only for the use of the addressee and may contain information that is confidential. If you are not the intended recipient, you are hereby notified that any dissemination of this communication is strictly prohibited. If you have received this communication in error, please erase all copies of the message and its attachments and notify the sender immediately.
Accurate information. The applicant or insured declares that all the information provided in the application is true and correct even if the information has been entered or suggested by your insurance agent or broker. The insured understands that eligibility for insurance and quote proposal is based on the truth and completeness of the information provided on the insurance application. Misrepresent, omission, whether known or unknown, could affect the insurance quote, policy and coverage terms. Any fraudulent statement, omission, or false statement in an application for insurance or declaration could affect the insurance coverage.
Fraud Statement. If a specific fraud statement is applicable for your state, disregard the statement below and only refer to that fraud statement. Any person who knowingly and with intent to defraud any insurance company or an application for insurance containing any false information or conceals for the purpose of misleading information concerning any fact material there to commits a fraudulent insurance act which is a crime with possible criminal and or civil penalties as well as voiding insurance contract. The insured acknowledges that they are applying for insurance on the basis of statements contained therein. The insured agrees that such policy shall be null and void if such information is false, misleading, or would materially affect acceptance of the risk by the Company. The undersigned is an authorized representative and certifies that reasonable inquiry has been made to obtain answers to all questions on insurance company applications. You certify that all answers on all applications are true, correct, and complete to the best of your knowledge.
You Select Limits and Terms. The Insured ultimately select the insured values, limits, terms, and coverages elected. If there are any areas that need to be evaluated, or should any of your exposures change, please inform your Agent and Diesel Insurance. It is incumbent upon the Insured to verify limits and coverages are acceptable and appropriate. Seek appropriate counsel to verify.
Additional limits of liability may be available. It is the insured duty to request additional limits or coverages, if desired. We cannot predict, nor assume, what limits or coverage the insured needs or desires. The insured is responsible for verifying that all limits are sufficient.
Value of Property. The limits or value of vehicles, trailer, or equipment change at a rapid pace and the insured should independently verify adequate limits.
Certificate of Insurance. Agent may issue unmodified ACORD certificates of insurance. You may include on the certificate an accurate representation of the coverage form and endorsements applicable to this policy at the time the certificate is issued. We do not review Certificates of insurance. Certificates of Insurance may only be issued as a matter of information. Certificates of Insurance do not amend, extend, or alter coverage afforded under this policy. We do not recognize Certificates of Insurance as endorsement or policy change requests. You must submit a separate electronic request if an endorsement or policy change if requested.
Statement for Brokered Business (Compliance with Texas Administrative Code 19.905). To serve your insurance needs, your agent has referred an application to Diesel Insurance. We do not have an appointment with this insurance company, therefore we are not authorized to bind coverage or to execute or issue the policy. We have the authority to prepare the application, collect and remit the premium, and deliver the policy and any endorsements. Please contact our agency if you require any changes to this policy or need to report a claim.
Standard Fee Statement (Pursuant CA Insurance Code Section 1623). We may charge fees for placement, servicing, technology, and underwriting of insurance coverages. Other parties to this transaction may also receive compensation in providing insurance products to you. The fees charged have been disclosed within this quote and you consent. The customer agrees to pay the Broker a fee for various insurance services. The broker fee is stated in the quote proposal and is non-refundable. Broker also may receive compensation from the insurer, directly or indirectly, for the customer purchase of any insurance as a part of this agreement.
Compensation Disclosure. We are committed to compensation transparency and to disclosing information that will assist you in evaluating potential conflicts of interest. In accordance with industry custom, we are compensated through commissions (ordinary, retail, wholesale, profit, contingent, supplemental) that are calculated as a percentage of the insurance premiums charged by insurers, and fees agreed to with our clients. We may place business with affiliated intermediaries that may also receive compensation.
Terrorism Risk Insurance Act. Insured acknowledge they were notified of the option to purchase TRIA coverage, if applicable, via the Terrorism Risk Insurance Act (TRIA) of 2007. Please inform your agent if you would like to purchase TRIA coverage.
Representation. We recommend the Insured obtain legal representation and or expert advice regarding your insurance purchase, limits, and coverage options. We are not authorized to provide legal or insurance recommendations, therefor the Insured should expert counsel to understand legal, risk or contract implications of the insurance purchase. When in doubt, obtain expert advice.
Coverage Recommendations. We do not provide insurance or coverage recommendations and insist that you consult expert counsel to advise on the insurance purchase.
Electronic forms and communication. Insured elects to allow all insurance policies and related documents or communications to be sent electronically to the email address provided and acknowledge they will not receive paper copies. Our primary contact is your insurance agent. The insured must update their agent and Diesel in the event their email address changes.
Complaints Procedure. We commit to handling complaints promptly and fairly. We consider a complaint to be any expression of dissatisfaction. We prioritize complaints and will work to resolve issues as soon as possible. If you wish to make a complaint, contact Jason@dieselinsure.com. If you are not satisfied within a reasonable timeframe, you may contact your State Department of Insurance.
Duty of Disclosure. The insured and agent have a duty to disclose accurate and timely information that may affect their insurance. The insurance application questions are material to the underwriting process, and it is imperative the applicants provide full disclosure of all facts, and in the event of a change, the information shall be kept updated and accurate.
Inspections and Reports. Insured agrees to inspection of company records, vehicles, drivers, DOT compliance or information required by insurance company. The insured authorizes underwriting reports including but not limited to credit report, motor vehicle reports, driver reports, financial reports, vehicle or DOT reports.
Insurance Term Glossary. It is incumbent upon the insured to ask their agent for clarification if you do not understand any questions, terms, conditions, definitions or statements in the application, policy, or insurance document. Policy Terms. The policy contains terms and conditions applicable in the event of a loss or claim. An insurance quote is an outline of the coverage proposed based on the information provided by you or your insurance agent. This quote proposal does not include all the terms, exclusions, limitations, and conditions of the actual policy contract language. For exact policy provisions and conditions, please refer to the insurance policy or request a copy. In the event of a disparity between the quote and actual policy, the insurance policy terms will prevail. Please read your insurance policies and review the specific details of coverage, conditions, exclusions, and limitations.
Renewal information. The Insured agrees that coverage selection, limits, optional choices may apply to future renewal policies unless the insured notify their agent and company and request a change or submit a new application.
Updated information. The Insured must inform their insurance agent and Diesel, as soon as reasonably possible, of any updated exposure info which may be material to the coverage, limits, terms, rating, eligibility or underwriting process.
Review Policy Terms. The Insured confirms that they have reviewed, read, understand and agree to terms and conditions outlined in this quote and will notify their insurance agent and Diesel, if any changes are required. The insured verified that the policy provides the requested coverages.
Claims Reporting. All claims must be reported promptly regardless of potential size, severity, details, or fault. Failure to do so may prejudice the claim. Please read the Claims Conditions and reporting procedures in your policy.
Minimum Earned Premium. The policy may include a minimum earned premium and various third party fees, which are non-refundable after binding.
Changes must be in writing. To ensure insured requests for changes are properly communicated, please communicate request to your agent who will promptly inform Diesel via our online portal or email.
Accurate Schedules. It is the insureds responsibility to ensure values and policy schedule including limit, coverage, vehicle, trailer, and driver schedules are accurate. If values or schedule require update please request an update in writing to your agent. The insured further acknowledge that the policies contained in this proposal may be subject to final audit or adjustment.
Third Party Notices. Notices you receive from your Insurer or a Premium Finance Company regarding past due premiums or cancellation shall be considered notice from Diesel Insurance Solutions Inc.
Rate changes. In the event underwriters deem the information provided on the application to be inaccurate, we may change classification and apply proper rates, or premiums charged, after binding.
Subjectivities on Quote. Any subjectivities stated in the quote proposal must be complied with prior to binding or insurance purchase.
Minimum Earned Premium. A minimum earned premium may apply on this policy. This amount is nonrefundable by the insurance company once the policy is bound.
Flat Cancellation. We do not offer Flat Cancellations once the policy is bound.
Premium Finance Disclosure Statement. We may act as a premium finance intermediary when we obtain quotes to finance your insurance premium. We may earn a commission based on financed premium from the premium finance company. You are not required to accept the premium financing terms from any companies we recommend and may shop for alternative companies.
Personal information. Personal and corporate information may be collected in connection with the insurance application. Such information may be disclosed to third parties related to our services. You may review your information and request corrections of inaccuracies.
Applying for insurance. The Insured consent and authorize Diesel and our various insurer to: Collect, use and disclose information on this insurance application to, insurers and other appropriate parties necessary fulfil our insurance activities and obligations, underwrite, determine premium, terms, investigate and settle claims, analyze results, detect and prevent fraud. We may contact the agent or applicant by electronic and non-electronic method. Insured authorized this usage.

Financial Rating of Carrier. Visit DemoTech, A.M. Best, Standard & Poors, or Moodys website to verify the insurance rating of an insurer. Please verify the insurance you purchase is from an insurance carrier that meets your risk tolerance. We cannot recommend nor endorse an insurance carrier or warranty their Financial performance.
Limitation of liability. By continuing to utilize our websites and services, you agree to the following terms. The Insured and Agent hereby agree that the aggregate liability of Diesel Insurance Services Inc., arising out of or relating to any services rendered on the Insured's account, shall not exceed the lesser of the premium paid for the applicable insurance policy or $5,000. Furthermore, Diesel Insurance Services Inc. shall not be liable under any circumstances for any indirect, special, incidental, consequential, or punitive damages, or for any lost profits or other economic loss arising out of or relating to such services. This limitation of liability shall apply to the fullest extent permitted by applicable law. By continuing to engage the services of Diesel Insurance Services Inc., the Insured and Agent acknowledge their understanding and acceptance of this limitation of liability. If the Insured or Agent does not agree to this provision, they must immediately cease utilizing the services of Diesel Insurance Services Inc. The Insured and Agent expressly waive and release any and all claims, demands, actions, causes of action, or suits of any kind or nature whatsoever, known or unknown, suspected or unsuspected, which they may now have or hereafter have against Diesel Insurance Services Inc. arising from or relating to any services, exceeding the limitations set forth herein.
Additional Policies and Terms. Additional terms or conditions may apply as stated in the Terms of Use policy or Producer Agreement.
